Article 1 — Purpose and Scope
1.1 These General Terms and Conditions of Sale (the “Terms of Sale”) govern the sale of products offered by Caffè Poli Canada, operated by 9487-8451 Québec Inc., including through its website and orders accepted by telephone or email.
1.2 These Terms of Sale apply to purchases made by individual consumers and, subject to any specifically agreed terms, to orders placed by business customers.
1.3 These Terms of Sale should be read together with the website's Terms of Use, Shipping Policy, Return and Refund Policy, and Privacy Policy.
1.4 Caffè Poli Canada may amend these Terms of Sale. The version applicable to an order is the version disclosed to the customer at the time the contract is concluded, subject to mandatory legal provisions.
1.5 Nothing in these Terms of Sale shall be interpreted as limiting or waiving any mandatory consumer rights under applicable law.
Article 2 — Customer Accounts and Information Provided
2.1 Creating a customer account is not required to make a purchase from the Caffè Poli Canada online store.
2.2 Customers may place orders using guest checkout or by signing in to their account, where this option is available.
2.3 Customers agree to provide accurate and complete information necessary to process their orders, including contact details, shipping addresses, and billing information.
2.4 Where an account is created, customers must safeguard the confidentiality of their login credentials and notify Caffè Poli Canada of any unauthorized use of which they become aware. This obligation does not limit their legal rights in cases of fraud or unauthorized use of a payment method.
Article 3 — Products and Availability
3.1 Caffè Poli Canada offers products including whole-bean coffee, ground coffee, capsules compatible with certain brewing systems, ESE coffee pods, coffee machines, and accessories.
3.2 Essential product characteristics, packaging, prices, and any applicable specific conditions are provided on the relevant product pages or in the corresponding commercial offers.
3.3 All products are offered subject to availability.
3.4 If a product becomes unavailable after an order has been concluded, Caffè Poli Canada will contact the customer to propose an appropriate solution in accordance with applicable rights. No substitute product will be imposed without the customer's consent.
3.5 Product photographs and illustrations are intended to present the products. They do not diminish the obligation to ensure that products conform to the descriptions, characteristics, and representations provided to customers.
Article 4 — Orders
4.1 Orders may be placed through the online store or, where such services are offered, by telephone or email.
4.2 There is no minimum purchase amount for orders placed through the online store.
4.3 Before confirming an online order, customers may review the selected products, quantities, prices, applicable charges, and shipping arrangements, and correct any errors.
4.4 An order is concluded in accordance with the checkout and confirmation process presented to the customer and the rules applicable to distance contracts.
4.5 An order confirmation or summary is provided to the customer in accordance with the platform's functionality and applicable legal requirements.
4.6 Business orders placed under a specific commercial offer may be subject to additional terms agreed upon in writing by the parties.
Article 5 — Prices and Taxes
5.1 Prices displayed on the Canadian online store are expressed in Canadian dollars (CAD), unless otherwise indicated.
5.2 Applicable taxes are presented in accordance with legal requirements and itemized for the customer before the order is confirmed.
5.3 Shipping charges and any other applicable fees are disclosed before the contract is concluded.
5.4 Caffè Poli Canada may change its prices for future orders. Subsequent price changes do not affect the price of an order already concluded, except where the parties have validly agreed otherwise or applicable law permits.
5.5 Prices and terms offered to business customers under specific agreements may differ from those available through the online store.
Article 6 — Payment for Online Orders
6.1 For purchases made through the online store, payment is due when the order is placed, using the payment methods offered at checkout.
6.2 Electronic payments are processed by the payment service providers used by the online store.
6.3 Caffè Poli Canada never asks customers to send confidential banking information, such as the full security code of a payment card, by email.
6.4 If payment authorization is declined, the order may not be completed. Any issue involving an order that has already been concluded will be handled in accordance with applicable obligations.
Article 7 — Special Payment Terms for Business Customers
7.1 Certain business customers, including distributors, resellers, and establishments in the hotel, restaurant, and café (HORECA) sector, may be eligible for deferred invoicing, subject to prior approval by Caffè Poli Canada.
7.2 Payment terms are determined individually under the commercial agreement concluded with each business customer.
7.3 The agreed terms may specify invoicing arrangements, payment due dates, trade credit limits, and delivery conditions.
7.4 In the absence of a prior agreement authorizing deferred invoicing, standard payment terms apply.
7.5 In the event of late payment by a business customer, the applicable consequences are those provided for in the customer's commercial agreement and under relevant legislation. No interest, penalty, or additional charge that has not been validly established will be automatically imposed.
7.6 To the extent permitted by law, the specific provisions of a written commercial agreement prevail over these Terms of Sale with respect to matters expressly governed by that agreement.
Article 8 — Shipping Destinations and Delivery
8.1 The Caffè Poli Canada online store currently offers shipping within Canada, subject to the eligible destinations indicated during checkout.
8.2 The estimated standard delivery time is 5 to 9 business days, generally comprising 2 to 3 business days for order processing and 3 to 6 business days for transit.
8.3 Standard shipping charges are calculated primarily according to the total weight of the order and are displayed to the customer before payment is confirmed.
8.4 Depending on the delivery address and the options available at the time of purchase, customers may also be eligible for local delivery or pickup at a partner distribution location.
8.5 Detailed conditions, charges, and pickup arrangements are set out in the Shipping Policy, which forms part of the contractual information disclosed to the customer.
8.6 Stated delivery times are operational estimates and do not affect consumers' rights in cases of delay, non-delivery, or failure to perform contractual obligations.
Article 9 — Receipt of Products and Delivery Issues
9.1 Customers are encouraged to inspect the apparent condition of the package and products upon receipt.
9.2 In the event of a damaged package, missing item, incorrect product, or defective product, customers are encouraged to contact Customer Service promptly at caffepolicanada@gmail.com.
9.3 To facilitate the handling of a claim, customers may provide their order number, a description of the issue, and relevant photographs where possible.
9.4 Caffè Poli Canada will review the situation and propose an appropriate resolution in accordance with the applicable policy and the customer's legal rights.
9.5 Failure to report an issue within a recommended voluntary timeframe does not deprive consumers of any rights or remedies available under the law.
Article 10 — Returns, Exchanges, and Refunds
10.1 The commercial terms governing returns, exchanges, and refunds are detailed in the Return and Refund Policy published on the website.
10.2 For reasons of food safety, hygiene, and quality preservation, coffee products are generally not eligible for change-of-mind returns, subject to mandatory consumer rights.
10.3 Damaged, defective, non-conforming, incorrect, or unfit-for-consumption products will be reviewed and handled in accordance with applicable legal obligations.
10.4 Coffee machines and accessories may be subject to separate return conditions, taking into account their nature and the applicable warranties.
10.5 The commercial return policy does not limit statutory warranties or consumers' rights to cancel or terminate a contract in circumstances provided for by law.
10.6 Refunds required by law are issued in accordance with the procedures and timeframes prescribed by applicable legislation.
Article 11 — Statutory Warranties and Commercial Warranties
11.1 Products sold by Caffè Poli Canada are covered by applicable statutory warranties, including those relating to quality, normal use, durability, and conformity of goods.
11.2 Where a coffee machine or accessory is covered by a manufacturer's or distributor's commercial warranty, the terms of that warranty are communicated based on the information available.
11.3 An additional commercial warranty does not replace or reduce consumers' statutory warranty rights.
11.4 Any product-related claim may be submitted to Customer Service, which will provide guidance on the appropriate steps depending on the nature of the issue.
Article 12 — Order Cancellations
12.1 Any request to cancel an order should be communicated to Caffè Poli Canada as soon as possible.
